In this episode of The Caravan Baatcheet, Disha Wadekar, an advocate in the Supreme Court of India, discussed the recent apex court ruling that upheld ten percent reservation for the economically weaker section, or EWS, among the general category. Wadekar, who represented one of the petitioners in the cases against EWS, said that the ruling is against the basic structure doctrine of the Constitution, as it removed the basis of social justice from the provisions of reservation. She broke down the three issues that the court addressed, that of equality, the constitutional cap of 50 percent on reservations, and the exclusion of Scheduled Castes, Scheduled Tribes and Other Backward Classes from EWS. Wadekar asserted that in essence, the economic basis is a smokescreen and the EWS reservation is a caste-based reservation for the upper or forward castes, privileging the already privileged section of society.

कारवां बातचीत के इस एपिसोड में होस्ट विष्णु शर्मा ने सुप्रीम कोर्ट की वकील दिशा वाडेकर से EWS आरक्षण पर चर्चा की. सुप्रीम कोर्ट ने हाल के एक फैसले में 2019 के EWS आरक्षण कानून को सही ठहराया है. इस कानून के पारित हो जाने के बाद इस कानून को सर्वोच्च अदालत में चुनौती दी गई थी और दिशा ने इस मामले में याचिकाकर्ताओं की पैरवी की थी. दिशा का कहना है कि यह कानून संविधान के बुनियादी ढांचे का उल्लंघन करता है. वह कहती हैं कि यह कानून ST/SC/OBC आरक्षण को भविष्य में खत्म कर देने का आधार भी स्थापित करता है. उन्होंने बताया कि असल में यह कानून देश का पहला ऐसा कानून है जो जातिगत आधार पर दिया गया है क्योंकि इससे पहले की आरक्षण व्यवस्था का आधार सामाजिक और शैक्षिक पिछड़ापन था.
